Your continued use of the Website following such amendment of these Terms will represent an agreement by you to be bound by these Terms as amended. We recommend you review the Terms for amendments each time you use the Website and before placing any Order.
Use of the website
The website may be accessed by guests or subscribers. If you wish to become a subscriber of the website, please complete input your details in the form presented. Your personal information will be handed in accordance with our Privacy Policy. You must not use another members’ account without permission. You must keep your password secure as you are responsible for any activity on your account. You agree to notify us immediately if you become aware of any security breach or any unauthorised use of your password or account. If you forget your password you may click on the relevant link located on the website and we will email you a new password.
Purchases made on the website
Any purchase made by you is subject to these Terms (Order).
Any Order made on this website is an acknowledgement by you that:
- you are over the age of eighteen (18) years;
- you accept these Terms;
- you agree that you have entered into a legal contract with Phenomenology Press in relation to these Terms;
- these Terms constitute the entire agreement between you and Phenomenology Press for the supply of goods subject of the Order, and
- you have previewed and confirmed that the goods in your cart are correct.
We recommend you carefully preview all goods before adding them to your shopping cart and proceeding with your Order.
You and Phenomenology Press will enter into a contract for the sale and supply of goods if you make payment in full (plus any applicable delivery charges) on the website for the goods or service (or both) in your cart, and the Order is accepted and confirmed by Phenomenology Press.
Once you have completed the steps above and completed your Order, you cannot cancel or revoke your Order, unless expressly provided for in these Terms.
You acknowledge that:
- the transmission of your Order or the confirmation of any payment, made through an electronic instruction may not be received by Phenomenology Press for reasons beyond the reasonable control of you or Phenomenology Press (or both), including but not limited to, electronic failure, mechanical, software, computer, or telecommunications, or the omission or failure of third party website providers or systems;
- Phenomenology Press may act on and process all completed electronic instructions transmitted or issued through the website without further consent from or reference to you;
- Phenomenology Press may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
You will receive an email from Phenomenology Press as soon as practicable after you have submitted your Order is completed and payment is received.
If your Order is not accepted by Phenomenology Press, we will notify you by telephone or email as soon as possible and arrange for a full refund of any payment made by you to be processed.
Phenomenology Press may, in its sole and absolute discretion, accept or reject any offer made by you for any reason (or no reason), including an error in the advertised price for, or description of, the goods on the Website, or an error in your Order.
Any representations made about stock availabilities are accurate to the last known stock level and are subject to change. If Phenomenology Press cannot supply a particular good, Phenomenology Press will notify you by telephone or email as soon as possible and arrange for a full refund of any payment made by you to be processed.
Phenomenology Press will be deemed to have accepted your Order following confirmation that the Order has been shipped or is ready to be collected, as applicable.
Price
Prices shown are in Australian dollars and include GST. Prices shown with each item do not include delivery and handling charges, which are calculated at checkout and are in addition to

Payment
All payments must be made in full prior to acceptance of an Order by Phenomenology Press.
To the extent permitted by law, Phenomenology Press will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by a user where a credit card or PayPal account is fraudulently used or is used in an unauthorised manner.
Supply and Delivery
Phenomenology Press will sell and supply the goods to you as described in your Order confirmation email.
Goods may not be available for immediate delivery. Phenomenology Press will endeavour to deliver your Order to you within ten (10) days of the date on which you placed your Order, except if the Order is for an item purchased via pre-order.
If Phenomenology Press gives you notice that it will be unable to deliver your Order within 10 business days of receipt of your Order due to lack of stock, you may cancel your Order without charge, and Phenomenology Press will arrange for a full refund of any payment made by you to be processed.
Delivery times may be greater than 10 business days for regional or remote areas.
Delivery by Post
Delivery charges (if any) are payable in addition to the price for the goods subject of an Order. The delivery address must be an address within Australia and cannot be a freight forwarding location.
If you wish to change the delivery date or delivery address please contact us via the website at least 48 hours prior to the dispatch of your Order.
Phenomenology Press will use best endeavours to dispatch your Order within any estimated timeframes, however Phenomenology Press does not warrant that these timeframes will always be met.
Returns and Refunds
If an item supplied by Phenomenology Press is received by you either damaged or incomplete, or is not received at all, please contact us via the website and we will discuss how best to provide you with what you ordered. This may include a full refund, partial refund, or replacement.
If the item has been damaged or lost in transit, we may also follow up on your behalf with the courier.
Disclaimer
To the extent permitted by law, Phenomenology Press excludes all liability to you for loss or damage of any kind relating to the website including, but not limited to, loss or damage you might suffer as a result of (1) you acting, or failing to act, on any information contained on or referred to on the website or any linked website; (2) personal injury or property damage of any kind resulting from your access or use of the Website; and (3) any unauthorised access to or use of the website.
Except as expressly provided in these Terms, and to the fullest extent allowed by the law, Phenomenology Press will not be liable for any direct, indirect, special, incidental or consequential damages arising out of your access to or use of the website.
This clause is not intended to exclude or limit any rights which you may have under the Competition and Consumer Act 2010 (Commonwealth).
